Snapalabra: End User License Agreement (EULA) & Privacy Policy

This End User License Agreement ("EULA") and Privacy Policy ("Policy") is a legal agreement between you ("User") and Edward Murphy ("we," "us," "our"), the developer of the Snapalabra mobile application ("the App").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA and Policy. If you do not agree to these terms, please do not use the App.

1. End User License Agreement (EULA)

1.1. License Grant

Subject to your compliance with these terms, Snapalabra grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices you own or control.

1.2. Restrictions

You may not:

  • Copy, modify, create derivative works of, reverse engineer, decompile, or disassemble the App.
  • Remove any copyright or other proprietary notices from the App.
  • Use the App for any illegal or unauthorized purpose.
  • Use the App to harass, abuse, or harm another person.
  • Distribute, sublicense, or transfer the App to any third party.
  • Use the App in any way that violates applicable laws or regulations.

1.3. Subscription Terms

The App offers an auto-renewing subscription called "Basic Monthly".

Payment: The subscription fee (€9.99 EUR or the equivalent in your local currency) will be charged to your iTunes or Google Play account upon confirmation of purchase.

Renewal: Your subscription will automatically renew at the end of each monthly period unless auto-renew is turned off at least 24 hours before the end of the current period.

Cancellation: You can manage or cancel your subscriptions at any time through your device's Account Settings (iTunes or Google Play). Please note: You cannot cancel the current subscription during an active subscription period.

Web Availability: Subscriptions cannot be purchased on the web version of the App.

Refunds: Refunds are handled by Apple and Google according to their respective policies. We do not process refunds directly.

Price Changes: We reserve the right to change subscription fees. Any price changes will be communicated to you and will only apply to subsequent subscription periods.

1.4. Intellectual Property

All rights, title, and interest in and to the App (including but not limited to code, graphics, logos, and the "Snapalabra" name) are and will remain the exclusive property of Snapalabra and its licensors.

1.5. Termination

This EULA is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.

1.6. Disclaimer of Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

1.7. Limitation of Liability

IN NO EVENT SHALL SNAPALABRA OR EDWARD MURPHY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

1.8. Indemnification

You agree to defend, indemnify, and hold harmless Snapalabra and Edward Murphy from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the App or violation of these Terms.

1.9. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from this EULA or your use of the App shall be resolved through binding arbitration in accordance with the rules of the Irish Arbitration Association.

2. Privacy Policy

2.1. Information We Collect

We collect information to provide, improve, and secure our services.

a) Information You Provide:

  • Account Information: When you sign up via Google Sign-In or Apple Sign-In, we collect your email address, name, and profile information through Firebase Authentication.
  • User Content: Images you capture or upload from your camera or gallery, speech (audio) recordings, and resulting text conversions. This data is core to the App's functionality.
  • Learning Progress: Your vocabulary progress, completed lessons, and learning statistics stored locally and synced across devices.
  • Purchase Data: Subscription status and transaction history through RevenueCat and app stores (Apple/Google). We do not store payment details.

b) Information Collected Automatically:

  • Usage Data: App interactions, features used, session duration, and performance metrics through Firebase Analytics.
  • Device Information: Device type, operating system version, unique device identifiers, and network information.
  • Crash Reports: App crashes and errors through Firebase Crashlytics.
  • Connectivity Data: Network status and connection quality through connectivity_plus package.

2.2. Third-Party Services and Data Sharing

We use the following third-party services that may collect and process your data:

Firebase Services (Google LLC):

  • Firebase Authentication: User authentication and account management
  • Firebase Analytics: App usage analytics and user behavior tracking
  • Firebase Crashlytics: Crash reporting and app stability monitoring
  • Firebase Dynamic Links: Deep linking functionality

RevenueCat (RevenueCat, Inc.):

  • Subscription management and tracking across iOS and Android platforms
  • Purchase validation and receipt processing

  • Google Sign-In: Authentication via Google accounts
  • Apple Sign-In: Authentication via Apple ID
  • Image Processing: Local image processing for vocabulary learning
  • Audio Playback: Local audio file management and playback

2.3. How We Use Your Information

  • To provide, maintain, and improve the App's core features (image processing, speech-to-text conversion, language learning)
  • To manage your subscription and authenticate your access to premium features
  • To sync your learning progress across devices
  • To communicate with you about updates, security alerts, and support messages
  • To analyze trends and user behavior to enhance the user experience
  • To prevent fraud and abuse
  • To provide customer support

2.4. Data Storage and Security

Your data is stored using the following methods:

  • Local Storage: Learning progress and preferences stored locally using shared_preferences and path_provider
  • Cloud Storage: User accounts and synced data stored securely in Firebase
  • Cache Management: Images and audio files cached locally using flutter_cache_manager
  • Security: All data transmission is encrypted using industry-standard protocols

2.5. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this policy:

  • Account information: Until account deletion
  • Learning progress: Until account deletion or 3 years of inactivity
  • Usage analytics: Aggregated data retained for up to 2 years
  • Crash reports: Retained for 90 days

Depending on your location, you may have the right to:

2.7. International Data Transfers

Your information may be transferred to and processed in countries other than your own. We ensure appropriate safeguards are in place to protect your data in accordance with applicable privacy laws, including Standard Contractual Clauses where applicable.

2.8. Children's Privacy

The App is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

2.9. Data Breach Notification

In the event of a data breach that may affect your personal information, we will notify you and relevant authorities within 72 hours as required by applicable law.

2.10. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to enhance your experience. You can control cookie settings through your device or browser preferences.

2.11. Changes to This Policy

We may update this EULA and Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on this page and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
